Gravity Networks operates this shop and this website, including all information, content, features, tools, products, and services associated herewith, to provide you, the customer, with a curated shopping experience (the “Services”). Gravity Networks is powered by Shopify, which allows us to provide the Services to you.

We exclusively offer digital products, in particular digital e-books and downloads, which are not delivered on a physical data carrier.

We have made every effort to accurately display our products and services in our online shops. However, we do not guarantee that the appearance, presentation, or quality of any product or service will exactly meet your expectations.

All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of products we offer to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. Gravity Networks reserves the right to accept or decline your order at its sole discretion for any reason. Your order is not accepted until Gravity Networks confirms acceptance. We must receive and process your payment before your order can be accepted.

Please review your order carefully before submitting it, as Gravity Networks may not be able to accommodate cancellation requests once the order has been accepted. In the event that we do not accept an order, or if we modify or cancel an order, we will attempt to notify you via the email address and/or phone number provided at the time the order was placed.

You represent and warrant that your purchases are for your personal use only and not for commercial resale, redistribution, or public distribution.

SECTION 4 – PRICING AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our shops. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such payment method for the purchase, and (iii) charges incurred by you will be honored by your payment provider.

All prices are final. Due to the small business status (pursuant to § 19 UStG / German Value Added Tax Act), no VAT is charged and therefore not displayed.

SECTION 5 – DIGITAL DELIVERY

Our products are delivered exclusively in digital format. No physical shipping will take place.

Upon successful completion of the purchase, the customer will receive access to the digital product, a download link, or a comparable digital delivery method.

We are not liable for delays caused by technical problems on the part of the customer, the email provider, the payment service provider, or other circumstances beyond our control.

SECTION 6 – INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, as well as their design, selection, and arrangement, are the property of Gravity Networks, its affiliates, or licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or use any of the materials or digital products without our prior written consent.

By purchasing a digital product, you acquire only a simple, non-transferable right of use for personal use. Any redistribution, duplication, publication, making available to the public, commercial use, or resale is prohibited without our express written consent.

SECTION 7 – OPTIONAL TOOLS

We may provide you with access to third-party tools which we neither monitor nor have any control or input over.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you access.

We are not liable for any harm or damages related to your access to third-party websites or your purchase or use of products, services, resources, or content on any third-party websites.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Gravity Networks is powered by Shopify, which allows us to provide the Services to you. However, all sales and purchases you make in our shop are directly with Gravity Networks. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Gravity Networks, including any injuries, damages, or losses resulting from the purchase of products and services.

SECTION 10 – PRIVACY POLICY

All personal data we collect through the Services is subject to our Privacy Policy, which can be viewed here [https://gravitynetworks.store/policies/privacy-policy], and certain personal data may also be subject to Shopify’s Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes personal data regarding your access to and use of the Services to provide and improve the Services for you.

You may not, directly or indirectly, access or use the Services for any unlawful or abusive purpose, including but not limited to violating intellectual property rights, distributing malware, circumventing technical protection measures, or engaging in abusive automation of access.

SECTION 14 – AGENTS

If you choose to adopt the standard Shopify section regarding agents, leave it as is. If you do not require it and Shopify does not mandate it, you may omit this section. For a small e-book shop, this is generally not critical for the customer's purchase decision. Please check if your active Shopify template requires it automatically.

SECTION 15 – CANCELLATION, RETURNS AND REFUNDS

Our products consist exclusively of digital content that is not delivered on a physical data carrier.

Consumers are generally entitled to a statutory right of cancellation. However, in the case of digital content, this right of cancellation may expire prematurely if the customer expressly agrees that we begin the execution of the contract before the cancellation period expires and simultaneously acknowledges that they lose their right of cancellation upon the start of the execution.

By completing the purchase and providing the corresponding express consent during the ordering process, you agree that we will begin providing the digital content before the cancellation period expires. You simultaneously confirm that you will lose your right of cancellation as a result.

For this reason, digital downloads are generally excluded from returns, exchanges, and refunds after purchase.

SECTION 16 – DISCLAIMER OF WARRANTIES

The information provided on or through the Services is for general informational purposes only. We do not warrant the accuracy, completeness, or usefulness of this information.

UNLESS EXPRESSLY STATED BY GRAVITY NETWORKS, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED FOR YOUR USE “AS IS” AND “AS AVAILABLE” TO THE EXTENT PERMITTED BY LAW.

SECTION 17 – LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED BY LAW, GRAVITY NETWORKS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.

Mandatory statutory liability regulations remain unaffected, in particular in cases of intent, gross negligence, injury to life, body, or health, as well as mandatory consumer protection law.

SECTION 18 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Gravity Networks, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims made by any third party due to or arising out of your breach of these Terms of Service or applicable law.

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any other remaining provisions.
